Rep. Huffman Votes to Terminate the President’s Sham National Emergency Declaration

Washington, D.C.- Today, Congressman Jared Huffman (D-San Rafael) voted in support of H.J. Res. 46, a joint resolution to terminate President Trump’s national emergency declaration.

“President Trump’s emergency declaration is an unlawful grab for power, and a desperate attempt to get billions for his ineffective border wall contrary to the explicit direction of Congress,” said Rep. Huffman. “The President is not above the law, and he cannot be allowed to undermine the Constitution or the will of the American people by manufacturing a crisis that does not exist. That’s why I’m voting in support of this resolution to overturn the President’s sham declaration. This issue transcends party lines and partisan politics: President Trump’s sham emergency is a threat to fundamental tenets of our nation’s government, and Congress cannot look the other way.”

A group of 58 bipartisan former senior national security officials issued a statement asserting “there is no factual basis” for the President’s declaration. In addition, nearly two dozen former Republican Members of Congress sent a letter urging Republicans in office to support this resolution.

The National Emergencies Act of 1976 includes a process by which Congress can terminate a national emergency through expedited legislative procedures by enacting a joint resolution. Once the joint resolution passes the House, it will go to the Senate with an expedited timeline.
